TERMS AND CONDITIONS FOR SILVERLINE PHOTOGRAPHY AND VIDEOGRAPHY SERVICES
Purpose:
This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by both parties
Booking and Scheduling:
Upon your signature, the Photographer will reserve the time and date agreed upon and will not make other reservations for that time and date. For this reason, the Reservation Deposit is non-refundable, even if the date is changed or the event is cancelled for any reason, including acts of God, fire, strike, and extreme weather. The Reservation Deposit is to be paid at the time of signing the contract. The Reservation Deposit is applied towards the contracted Event Package. Client understands and agrees that the entire amount owed for the Event Package described in the contract is due 4 weeks before the Event, or on the Outstanding Balance Due date (if specified). Client agrees that if the balance is not paid by this time, the Photographer will not photograph the Event, with a loss of the Reservation Deposit by Client and no liability to the Photographer.
Pre-Event Consultation:
The parties agree to a pre-event consultation before the Event in order to finalise the actual shooting times, locations, and the Client’s request list (in writing) for specific photographs. The Client will be responsible for, or have someone designated, to identify people for whom specific photographs are desired. The Photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for group photographs. The photographers are equipped to handle most low-light situations. In situations where flash photography is prohibited or deemed to be unsafe, the Client agrees to accept the Digital Images as-is, given the technical limitations of low-light photography
Exclusivity / Guest Photography:
If the Photographer is the sole professional photographer at the event (as specified in the Event Details), it is understood that the Photographer will be the only one allowed to photograph the event. In which case, amateur photographers may take photos during the event if they do not interfere with the contracted Photographer and are not shooting the Photographer’s same posed shots. If a problem arises with any guest or attendee(s), the On-site Event Contact will be advised to handle the situation politely for the Photographer by enforcing the conditions of this agreement.
Co-operation of Guests and Other Service Providers:
The Client is responsible for the conduct of the guests. Coordination with other service providers may be necessary to complete all the photography as scheduled. The Client should share the photography schedule with other service providers to make sure that there are no conflicts with times. In addition, events during the Event should be planned to make the best use of time for all vendors.
The Photographer will not tolerate verbally or physically abusive behaviour, nor will the Photographer share its time or compete with guest photographers for the attention of the subjects. Unchecked guest conduct that interferes with photography will seriously affect the quality of the photographs taken and increase the number of photos that must be created. If the Client is unable to control the conduct of the guests or if the conduct of any of the Event guests damages any of the equipment of the Photographer, it will result in the early or immediate departure of the Photographer. The Client understands that in such an event, no refund will be given.
Non-Guarantee:
Although every possible care will be taken to produce photographs of all important and special moments during the Event, the Photographer cannot place an unconditional guarantee on the above. The Photographer will not be held responsible for any ruined photographs due to guests’ (or any other) flashes, or any other ruined photographs due to any other cause in or outside of the Photographer’s control.
Overtime Charges:
If the shoot extends beyond the agreed time, or additional photography and/or travel time, that is not included in the agreed package, be requested by the Client it will be charged ‘Client and Others’ will be billed for additional hours worked. The hourly rate is calculated by dividing the subtotal charged by the originally agreed hours, rounded up to the nearest hour, This sort does not factor in additional post-production time. No media will be worked upon or released until all outstanding accounts have been settled in full.
Failure to Perform:
In the unlikely event of a severe medical, natural, or other emergency, it could be necessary to retain a different photographer. The Photographer will make every effort to secure a skilled replacement photographer. The Photographer takes the utmost care with respect to exposure, transportation, and processing the photographs, including using professional-grade equipment and professional-grade backup equipment. However, in the unlikely event those photographs have been lost, stolen, or destroyed for reasons within or beyond the Photographer’s control, the Photographer’s liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost. Shoot99 is not responsible for photos that are obstructed or ruined due to guests taking photos, flashes from other cameras, or any other guest behaviour. Additionally, Shoot99 is not liable for obstructed or ruined photos caused by the actions of other vendors or venue staff.
Photography and Videography Limitation of Liability:
In the event that the Photographer and Videographer (referred to jointly as “Service Providers”) are unable to capture or miss an important moment during the event due to unforeseen circumstances, which include but are not limited to adverse weather conditions, equipment malfunctions, guest interference, obstructions, low lighting conditions, or any other factors beyond the control of the Service Providers. The Client acknowledges and agrees that the Service Providers cannot guarantee the capture of every moment or specific shots requested by the Client. Event photography and videography inherently involve a degree of unpredictability. The Service Providers shall not be held liable for any missed moments or for failing to capture specific shots requested by the Client due to unforeseen circumstances. The Client understands and accepts that these circumstances may occur despite the Service Provider’s best efforts. In the event of a complaint arising from missed moments or unfulfilled requests due to unforeseen circumstances, the Client shall not be entitled to a refund or any form of monetary compensation. The Service Providers commit to making reasonable efforts to capture all important moments and fulfil Client requests. However, the Client acknowledges that the nature of event photography and videography makes it impossible to guarantee the capture of every moment. It is the Client’s responsibility to communicate their specific photography and videography requests to the Service Providers in advance of the event. While the Service Providers will make efforts to adhere to these requests, they cannot guarantee their fulfilment under all circumstances. The Client agrees to provide reasonable cooperation and assistance to the Service Providers during the event to facilitate the capture of important moments. Failure to do so may impact the Service Providers’ ability to capture certain shots.
High-Resolution:
Images deliverable in High-Resolution (or known as High-Res) are 300DPI with 3000 Pixels in the longest edge.
Payment Terms, Discounts & Special Promotions:
The Client agrees that the Reservation Deposit is required at the time of signing the contract and the Outstanding Balance is due 3 weeks before the Event. The Reservation Deposit is non-refundable, even if the date is changed or event cancelled for any reason, including acts of God, fire, strike, and extreme weather. We reserve the right to charge a 100% Cancellation Fee (Loss of Business Fee) or Transfer Fee (Administration Fee). A minimum 21-days cancellation notice must be given in advance in writing to avoid total loss. Prices on this invoice are tentative and subject to change based on changing circumstances. The agreed price remains unchanged even if the work duration is reduced by the client. Additional charges apply for increased coverage time or other adjustments, determined by factors like additional hours, date changes, venue changes, etc. We are committed to delivering the services outlined in the invoice/quote or agreed upon through a written contract. Additional services and third-party services will incur additional charges. Clients are responsible for all expenses such as but not limited to, tolls, transportation, parking, during events lasting four consecutive hours or more.
Post-Production:
Wedding photography & videography post-production takes 4 to 8 weeks and is uploaded to a private gallery. Commercial photography post-production is typically completed within 48 hours unless otherwise agreed in writing. Commercial videography post-production timings are agreed in writing prior to the shoot. Upon initial receipt of the video, clients have a 30-day window to complete the revision form and email it back to us with any requested revisions. All clients are entitled to 2 video revisions to fine-tune and personalise the video to their taste. After the initial 30-day period, all post-video working files are deleted to optimise memory and make room for new projects in our studio. Revisions requested after the 30-day grace period will necessitate the reconstruction of post-production working files from scratch. This process typically takes one working day. An administrative fee for rebuilding post-production files will apply, starting from £350. The final fee depends on the video’s length that requires reconstruction. We cannot be held liable for technical problems, media loss, or accidental damage. We take every provision to avoid any technical issues via regular equipment servicing. Post-production includes various operations such as exposure adjustments, color corrections, cropping, retouching, resizing, and more. Basic post-production effects and filters are included and not charged separately.
Media Management & Storage:
Upon completion of post-production, digital files will be provided to the Client. These files will be delivered through a private online website or, in specific cases, via direct transfer using WeTransfer. The online storage of your media will be accessible for 30 days only. We retain the right to remove the media after a minimum of 30 days from the date of upload or immediately following the Client’s download. Clients are responsible for downloading their images within 30 days of receipt via the provided download link. We maintain backup copies of all media for 90 days, which can be made available upon request, subject to an administration fee. Should the Client wish to request RAW material coverage, this can be arranged separately, and advance notice is required before the actual shoot to ensure suitable storage arrangements.
